100% RELEASE OF LIABILITY
ASSUMPTION OF RISK – electric skateboard - CUSTOMERS (PURCHASERS OF ELECTRIC BOARDS)
Customer is aware that participation in riding, using, transporting, or otherwise coming in contact with an electric skateboard generally and particularly INVOLVES INHERENT RISKS OF PROPERTY DAMAGE, INJURY OR DEATH that no amount of care, caution, instruction or expertise can eliminate. Such dangers include, but are not limited to falls, loss of control, electromagnetic interference, equipment failure, and collisions with cars or people or with natural and man-made objects of any kind. Such risks and dangers are recognized and accepted. Customer FREELY ASSUMES ANY AND ALL SUCH RISKS, INCLUDING THE RISK OF ANY ALLEGED NEGLIGENCE of Slide4less LLC (DBA ELECTRICLONGBOARDS.COM), its owners, or employees.
ASSUMPTION OF RISK - Conditions
In addition to the above risks, customer understands and accepts that SURFACE CONDITIONS on roads, parking lots, walkways, stairs and any other area may become DANGEROUS. Such dangers include but are not limited to water, oil, debris, potholes, and speed bumps. Customer FREELY ASSUMES ANY AND ALL SUCH RISKS.
RELEASE FROM LIABILITY AND COVENANT NOT TO SUE
In consideration for being permitted to purchase an electric skateboard, CUSTOMER AGREES TO FOREVER DISCHARGE AND RELEASE FROM ANY LEGAL LIABILITY AND TO NOT SUE SLIDE4LESS LLC (DBA ELECTRICLONGBOARDS.COM) or it’s owners for any injuries or property damage caused by or resulting from any electric skateboard riding activities, INCLUDING BUT NOT LIMITED TO INCIDENTS ARISING OUT OF SLIDE4LESS LLC'S ALLEGED NEGLIGENCE.
INDEMNITY AGREEMENT
Customer agrees for himself/herself and his/her heirs, assignees and representatives to INDEMNIFY AND HOLD HARMLESS SLIDE4LESS LLC, its owners, and employees from any and all losses, claims, actions, causes of action, or proceedings of any kind which may be initiated by Customer or by any other person or organization on Customer’s behalf, including demands for damages, judgments, costs, loss of services, or expenses, arising from the activities contemplated by this agreement, including but not limited to reasonable attorney fees or arbitration fees incurred by SLIDE4LESS LLC or its owners.
THE CUSTOMER FURTHER ACCEPTS FULL RESPONSIBILITY FOR ANY AND ALL SUCH DAMAGE, INJURY OR DEATH THAT MAY RESULT FROM PRODUCT USE BY customer OR BY ANY CHILD OF customer OR ANY OTHER CHILD THAT SHOULD USE CUSTOMER'S DEVICE. SHOULD A CHILD OF CUSTOMER ATTEMPT TO BRING SUIT AGAINST Slide4less LLC, CUSTOMER AGREES TO DEFEND AND INDEMNIFY Slide4less LLC AGAINST SUCH SUIT.
THIS DOCUMENT IS A LEGALLY BINDING CONTRACT WHICH IS INTENDED TO PROVIDE A COMPREHENSIVE RELEASE OF LIABILITY, BUT IS NOT INTENDED TO ASSERT ANY CLAIMS OR DEFENSES WHICH ARE PROHIBITED BY LAW.
The purchaser acknowledges that:
There is an inherent risk in the operation of electric skateboards AND ASSUMES THE RISK OF ANY INJURY ARISING FROM THE OPERATION OF the PRODUCT being purchased.
The State of California prohibits the use of motorized skateboards on public roads. Purchaser acknowledges that it is the purchaser’s responsibility to be informed of and conform to all laws regarding the operation of motorized skateboards.
This device does not conform to federal motor vehicle safety standards.
Slide4less LLC (DBA electriclongboards.com) recommends the use of protective gear to avoid injury, which may include safety helmet, goggles, gloves, elbow and kneepads, leathers, appropriate shoes, and reflective clothing.
This device is not recommended for use in traffic or in the dark. Do not operate this device on wet, frozen, oily, or unpaved surfaces. Avoid uneven surfaces, holes, surface cracks, and obstacles.
High speeds, jumps, and trick maneuvers are dangerous and may result in loss of control and other accidents.
Never permit anyone else to operate this device unless they are aware of these warnings and all manufacturer recommendations.
Read all warnings and applicable manuals/directions before operating this device.
Pregnant persons should not use this device.
Never operate this device while under the influence of alcohol or drugs.
This Product is intended for adults and should only be used by minors with adult supervision.
Modifications or alterations to this device will void all express and/or written warranties.
THIS PRODUCT SHOULD NOT BE USED BY ANYONE UNABLE OR UNWILLING TO TAKE RESPONSIBILITY FOR THEIR OWN ACTIONS.
